Patents & Strategy: Why is it that strategy is important with respect to patents and intellectual property? Patents are by nature competitive instruments - they keep you competitors from practicing your invention. Much like chess pieces, your patents can be used to force your competitors to change their products, their market strategy, and more. However, this assumes that you have competitively valuable space protected. Which space is competitively valuable? That's a question of strategy.

Why You Should Care: The purpose of patents is to keep others from practicing your invention. However, there may be other ways to deliver the same results to the consumer by going around your patents. In many cases, products protected by patents - even many patents - are easily knocked off by competitors. Just because you have patents doesn't mean you're protected -- you need to have the right patents. If you don't have the right patents, your entire portfolio may have little competitive value.
